The real course designer used grass, trees, dirt and sand in his design and development of his golf course. Im suing him. I bet I win.

although I would never say anything even close to that in fear of being strucked by lightining I do have to admit that was quite funny.

As a guiar player I sometimes look for chords to songs on the web. The
people who provide these have the same problem. Apparently it is forbidden to teach someone the chords to a song without permission from the copyright owners. Although the lawyers in this case probaly have more of a point, it still seems rather silly and pointless to me. Artists should be honored if someone copies their stuff without an eye to financial gain.

Its the same the world over. Just take a look at what Union Pacific did to one of the well known Model Railroad firms several years ago. And look at how much they now charge if you want to display there logo on anything you produce. I guess the same goes for golf courses/architects. Whats to stop the creators here from creating a course and deliberately changing one(1) letter in that courses name.

Im sure many of us have an opinion as to the legality of this situation. A few have indicated that they feel the email was childish and petty. Just to play Devils Advocate here, I can see his point. I wont pretend to have any knowledge of the law in this situation, but you cant blame him for wanting to protect his interests in a multi-million (billion?) dollar industry. However I dont see anything threatening in his emails. He didnt threaten to sue. In fact he didnt even request the course be removed from the site. He only asked who gave the permission. I do realize that the implication was that permission was not given though.

We need to give some thought to what sort of integrity this site wishes to maintain. So far, the sight has always been above board and legit to the public eye. The sight does not allow even the discussions of piracy or cracks. I assume they have a good relationship with Electronic Arts. The site does not host any copyrighted software or copyrighted software that has been modified. Should this situation result in the REQUEST that the course be removed from the site, the owners of the site would need to decide if they want to comply out of curtesy, or stand by the letter of the law and respond in a manner that might raise questions about the nature of the entire site. Look at how the public perceives sites that host torrent files. These sites do not host any copyrighted software, but EVERYBODY knows they are not legit in the spirit of the law. I do not mean to imply that this site is doing ANYTHING wrong or questionable in hosting user created courses. Im simply pointing out that public impression of the site also should be considered if a request is made.
